The personal taxation system in New Zealand is supposed to be one of the simplest in the OECD but when it comes to investment funds life becomes more complicated. Claims of ‘taxation by stealth’ are not entirely without foundation.

A key objective of these few pages is to give both New Zealand investors (and overseas residents) contemplating investment through MoneyOnline enough information so that decisions can be effective from a tax perspective. It is not intended to cover every aspect of taxation applicable to managed or other investments and we also warn that selection of investments should not be made on the basis of taxation alone. Tax laws change frequently and what seemed to be a good deal this year may not be so attractive next. This guide will apply to most personal tax payers in New Zealand.

It is also important the readers distinguish between investors as taxpayers and investments which are taxpayers. ie. different tax paying entities.

Eg: Companies (shares) and NZ unit trust investment are taxpaying entities and can issue credits for the tax they have paid (imputation credits) when they pay dividends (distributions).

Finance company investments are not tax paying entities. They can deduct tax from interest paid to investors (withholding tax).

The guide may also be useful for overseas personal investors wanting to understand how the New Zealand tax system might affect investment decisions for NZ domiciled offers and Australian based offers that are registered for promotion in New Zealand.

Also note that Investment Statements and Prospectuses registered in New Zealand are not to be sent or given to any person outside New Zealand in any other jurisdiction in circumstances in which the offer of shares or distribution or use of the investment statement or prospectus would be unlawful.

The Cash Advantage Fund is a simple, flexible and tax effective investment solution which is similar in nature to investing in a call account, earning a very competitive interest rate.

Typically this fund is used as a call account with a competitive interest rate and is especially useful for settling share transactions with no entry or exit fees charged.

Fund Objective
The Fund aims to provide investors with pre-tax returns similar to a bank deposit. The Cash Advantage Fund has been set up in response to the benefits that result from the Portfolio Investment Entities (PIE) tax regime introduced on 1 October 2007.

Investment Strategy
This Fund is a passively managed fund, with all investment funds held in a bank deposit with Rabobank. Rabobank is the only bank in New Zealand with an AAA credit rating, the highest possible from international ratings agencies Standard & Poor's and Moody's.

Investment Strategy & Overview

20 shares are selected through a process from the constituents of the Dow Jones STOXXฎ Global Select Dividend 100 Index. The basket of 20 shares will be equally weighted and the selection process is repeated every quarter. Income is earned through dividends paid on the shares in the basket. Income is potentially increased by selling Call Options over the shares. Volatility with respect to the share price is reduced by buying Put Options to limit the downside risk of the shares. Returns can be further enhanced by leverage expected to be between 20% to 50% of the prevailing Net Asset Value of the Fund at any time, subject to set maximums (refer prospectus).

Investment Protection

The investment strategy involves using options to limit downside risk and enhance income. This means that while the price of each unit can decline in value, the employment of such strategies could limit such losses. Over the term, high income and some capital appreciation are expected.

Liquidity / Redemptions

There are two methods. The fund is expected to be listed on the NZ Stock Exchange and accordingly units may be sold on that exchange. Alternatively, units may be redeemed directly off market via the Trustee at Net Asset Value (less 1% fee). Redemptions are weekly in parcels of at least $50,000, however the Trustee intends to offer to accumulate redemption applications in parcels of at least $5,000 to make up $50,000 redemption and subscription parcels. This should also have the effect of keeping NZX traded parcels at, or close to, the Net Asset Value, i.e. discounts or premiums should be minimal.

PIE Compliant Fund Taxation

Celsius is tax efficient in that distributions are tax paid with tax capped at 30% under the PIE regime.

Application / Suitability

As returns are derived from investment in major (very large cap) global companies and options on those companies, the fund most closely fits the global equity (hedged) asset class. However the investment strategy should increase income distributions substantially over direct investment while reducing risk. Income risks are also reduced via the tax efficient PIE structure. Accordingly the investment is suitable for investors wanting to enhance the offshore equity component of their diversified portfolios but with minimal currency risk and lower price volatility risk. Investors should have a time horizon of 3 to 5 years.
